NATIONAL CONVENTION ON PFRDA BILL – 22-07-2011

More than 800 delegates representing AISGEF, Confederation of CGE & W, AIRF, AIDEF, STFI, AIFUCTO, BSNLEU, DREU and various Pensioners Associations participated at the National Convention on PFRDA Bill held at MPCU Shah Auditorium on 22nd July,2011. The proceedings of the convention were conducted by a presidium consisting of the following comrades:

The declaration was presented by Com. Sukomal Sen, Vice President( AISGEF) and seconded by Com. S.K.Syas(Confederation of CGE&W), Com.Basudeb Acharya, M.P., Com. Tapan sen, Genl.Secy (CITU), Com. M.K.Pandhe, Vice President (CITU), Com. Bhatnagar (AlIEA), Com. Pradeep Biswas (BEFI) addressed the convention. Besides, leaders of all participating Federation, viz shiv Gopal Misra (AIRF), Com. Rajendran(STFI), Com. Ashok Kumar Burman(AIFUCTO), Com. R. Muthusundaram (AISGEF),Com. Abhimanyu (BSNLEU)Com.Sardara singh(AIDEF), Com.Elangovan(DREU), Com. M. Krishnan(NFPE), Com. Shyam Sundar(BCPC) spoke to detail the dangers posed to the existing pensioners and the serving employees when the contributory scheme is brought in operation. Com. K.K.N Kutty, Secy.Genl., Confederation of CGE&W summed up the discussion and sought and obtained the approval of the house for the following programmes of action.

1. To organise a mass signature campaign to be submitted to the Prime Minister. (The draft prepared and circulated was felt to be too lengthy to employ it for a signature Campaign. Therefore it was decided to have a small petition (copy given enclosed) which could be used for the campign.)

2. The standing committee can be approached for a hearing by the participating organizations. The original draft letter addressed to the PM may be used as a background paper to prepare the petition to the Chairman, Standing Committee.

3. To organise joint State level Conventions between 1-8-2011 and 6-9-2011.

4. To organise March to Raj Bhawan preferably on 6-9-2011 at all state capitals.

5. To organise March to Parliament.

6. To organise a day’s strike.

The dates for the program at (5) and (6) will be finalized by the Steering Committee consisting of representatives of all participating Federations. The Steering Committee is expected to meet in the last week of August, 2011. The convention approved the setting up of the steering committee.

On behalf of the Presidium, the concluding speech was delivered by Com. R.G.Karnik. He appealed to all the participating organizations to take strenuous efforts to ensure full participation of their members in the programmes to compel the Government to rescind their decision and withdraw the Bill from the parliament.

   With reference to the above, the undersigned is directed to state that the matter has already been examined and it was advised earlier vide Board’s letter of even number dated 23-11-2009 that the earlier ACP Scheme (of October 1999) envisaged fulfillment of normal promotion norms such as bench mark, trade test, departmental exam, seniority-cum-fitness, etc., for grant of financial upgradation. Howaver, the Modified ACP Scheme, which has superseded the earlier ACP Scheme and effective from 1.9.2008,
prescribes that financial upgradation would be subject to fitness in the hierarchy of the Grade Pay within the PB-I. Thereafter, the benchmark of ‘Good’ till the Grade Pay of Rs.6600 in PB-3 end the benchmark of 'Very GOOd’ to the Grade Pay of Rs.7600 and above would be applicable for financial upgradation. As such, the MACPS criteria for upgradation are different from the ACP Scheme.

   Further, vide Board’s letter dated 28.12.2010 (RBE 188/2010). It has been clarified that where the financial upgradation under the MACPS also happens to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS, the benchmark for promotion shall apply to MACPS also.

Special Casual Leave for Differently Abled Persons working in Transport Corporations-TN

More good news from CM for differently-abled

   Tamilnadu Chief Minister J Jayalalithaa today said differently-abled people in the State Transport Corporations would be given special casual leave with pay on 3 December, which was being observed as International Day for Disabled.

   An official release here said such facility was being extended to the differently-abled people in government and government- aided institutions.


   On coming to know that those in the State Transport Corporations were not covered, Jayalalithaa today announced the extending of the benefit to them also.

   This is not the first time for the AIADMK government led by Jayalalithaa to come to the help of the differently-abled in the State.

   Only recently, Jayalalithaa has ordered enhancing the monthly assistance from Rs 500 to Rs 1000 to over 76,000 differently abled persons in Tamilnadu.

   The announcement was aimed at reaching out the beneficiaries covered under different schemes, including persons with severe disability and muscular dystropy

   She also announced the inclusion of differently-abled persons in the free gold and marriage assistance scheme launched by as soon as assuming the power after winning the Assembly elections.

   Under the scheme, which was one of the populist poll promises made by the AIADMK , the beneficiaries would get four gram of gold for making ‘Thaali’ (Thirumangalyam) and financial assistance of Rs 25,000.

   An official press release here said the Chief Minister wanted the differently-abled to be included in the scheme to enable them to get the benefits. The release said the State government would incur an additional expenditure of Rs one crore in view of this.

   Jayalalithaa also doubled the assistance given to women who had studied upto Under Graduate or Diploma from Rs 25,000 to Rs 50,000 and also announced free four gm gold coin for their marriage.

The Hon'ble Central Administrative Tribunal Allahabad in O.A. No. 682/2005 vide its order dated 31.3.2011 has directed the respondent No. 3, i.e., Secretary (Estt), Railway Board as under:-

.......ends of justice would be met, if the respondents constitute a Committee headed by a senior officer at the level of Joint Secretary in the Railway Board and Director in the Finance wing of Railways, which would consider the case of the applicants and also of the Department and arrive at a decision whether the matter needs to be reconsidered by the Respondènts for bringing back the pay parity amongst the Lab. Assistants the Libranans and the T. G. Ts.
One of the applicants or their authorized representative (any official of the Railways) may be given audience by the Committee. The Committee’s decision be made within a period of four months from the date of communication of this order.

2. In compliance of the directions of the Hon'ble CAT/Allahabad, Ministry of Railways (Railway Board) have decided to constitute a Committee consisting of the following:

i). Executive Director/Pay Commission-I, Railway Board .... Chairman
ii). Joint Director/Finance (Estt), Railway Board .... Member

3. The Committee will be headquartered at New Delhi and will submit its decision before 31.7.2011.

4. The Convener and Members of the Committee shall be eligible to draw TA/DA as admissible under the extant rules.

Sub:- Annual Returns about representation of SCs, STs, OBCs and Persons with Disabilities in Services - Meeting of the Liaison Officers of the Ministries / Departments.

   The Parliamentary Committee on the welfare of Scheduled Castes and Scheduled Tribes has expressed concern over non-submission of above referred returns in time by some Ministries / Departments.
The Cabinet Secretariat has also taken note of this issue. It has been decided to hold a meeting of the Liaison Officers of the Ministries / Departments, which have not sent the reports for the years 2009 and / or 2010 so far, on 27.7.2011 at 2.30 PM in Room No. 190, lst Floor, North Block New Delhi.

   2. It is requested that the Liaison Officer of the Ministry / Department may attend the meeting.

Govt takes over National Council for Teacher Education

 In a swift operation, the HRD ministry on Thursday night superseded the National Council for Teacher Education for six months through a gazette notification. The ministry had recently issued a show cause notice to the Council about the large scale irregularities in the grant of recognition to teacher training institutes.

All members of the NCTE – irrespective of the fact that their term is over or not – were asked to vacate their office. Chairperson MA Siddiqui, whose removal was earlier ordered by the HRD minister, has already gone to the Delhi High Court.

All powers and duties of the NCTE would now be carried out by officials appointed by the HRD ministry. On Friday, the ministry issued a separate order appointing Anshu Vaish, secretary, school education and literacy, as chairperson of NCTE and RP Sisodia, joint secretary, department of higher education, as member-secretary.

The gazette notification said that NCTE was issued a show-cause notice which cited several instances showing that the institution had failed to carry out its functions, "consistently defaulted" in its duties and did not comply with directions issued by the HRD ministry.

In its reply, NCTE admitted "there have been gross procedural lapses in processing of cases (for recognition) in terms of non-preparation of comprehensive agenda, intimation of deficiencies on the proposals to institutions within specified time frame and lack of supervision and monitoring." NCTE asked HRD to reconsider the move to supersede it and also said non-compliance of the government's direction was not "willful". But the government felt the reply was not convincing as NCTE had consistently failed and therefore taking over its functions was the only way out.

Sources said what particularly upset the ministry was the way NCTE's western regional committee went against not only HRD's specific direction but despite protest by the Maharashtra government gave recognition to 291 teacher training institutions. The Nagpur bench of the Bombay High Court had quashed the recognition given to these institutions and said it was a breach of government directive. The promoters of these institutions have now gone to the Supreme Court where is the matter is pending.

In the meantime, the apex court has set up a committee headed by former chief justice JS Varma to look into various issues relating to teacher education in the country as well the Maharashtra case of granting recognition to 291 teacher training institutes. The committee's terms of reference include an examination of teacher education courses and if they follow the teaching norms as set out by the Right to Education Act. The committee will also review whether the present system of empowering withdrawal of recognition to institutions is adequate. Besides, it will evolve standards and norms for evaluating teacher performance.
