SC DIRECTS CENTRE, STATES TO RESERVE 3% GOVERNMENT JOBS FOR DISABLED PERSONS

    The Supreme Court on Tuesday directed the Centre and all state governments to provide three per cent job reservation to disabled persons in all their departments, companies and institutions.

            A bench headed by Chief Justice P Sathasivam also clarified that the principle of not exceeding more than 50 per cent reservation would not be applicable while granting quota for disabled persons.

            The apex court directed the authorities to compile the number of vacancies in all their departments to give jobs to disabled persons under three per cent reserved quota within three months.

            The bench said it is an “alarming reality” that disabled persons are not getting jobs because of various social barriers forcing them to live life in poverty and negligence.

            It said the government has “categorical obligation” to protect the right of disabled persons and passed a slew of directions for providing jobs to them.

Service Tax on AC Classes/First Class from tomorrow i.e. 1st October, 2012

Levy of Service Tax on Railway Passengers Travelling in AC Classes/First Class from tomorrow i.e. 1st October 2012
No Service Tax to be Levied on Tickets Issued Prior to 1st October 2012
In Case of Cancellation of Tickets Issued on or after 1st October 2012, the Applicable Amount Including Service Tax to be Refunded by Railways

In compliance of the provisions contained in Finance Bill 2012 and subsequent notifications issued by Ministry of Finance, the Service Tax in case of railway travel will be levied on the fare of passenger services in the following classes from tomorrow i.e. 1st October 2012:-

(i) AC First Class, (ii) Executive Class, (iii) AC-2 tier Class, (iv) AC-3 tier class, (v) AC Chair Car class, (vi) AC Economy class and (vii) First Class.

Since an abatement of 70%  has been permitted on passenger services by Ministry of Finance,  the Service Tax will be charged on 30% of total fare including reservation charge, development charge, superfast surcharge which would be calculated as follows:-
1. Service Tax of 12% will be charged on 30% of fare (equivalent to 3.6% on the total fare)
2. Education Cess of 2% on Service Tax will be added (equivalent to 0.072% on total fare) and
3. Higher Education Cess of 1% on Service Tax will also be added (equivalent to 0.036% on total fare)
4. Total Service Tax implication will be (i)+(ii)+(iii)=3.708% on the total fare.

   On Concessional value tickets, service charge will be levied @ 3.708% of the total fare actually being paid by the passengers.

          Through a subsequent corrigendum issued by M/o Railways,  it has been clarified that the Service Tax would be collected on the tickets issued/bookings made on or after 01.10.2012.  Service Tax is not livable on tickets issued prior to 01.10.2012 and hence will not be collected on board the trains.
             
In case of cancellation of tickets booked by the passengers on or after 01.10.2012, the applicable amount including refundable Service Tax amount will be refunded by Railways as per Railway refund rules and Finance Ministry guidelines.

The amount of Service Tax collected from passengers will be deposited with the Ministry of Finance as per prescribed procedure.  Finance Departments of Zonal Railways have been instructed for proper accountal and remittance of Service Tax amount to the Government.

Proof of Identity during Train Journey

With a view to reduce chances of misuse of reservation system by unscrupulous elements, it has been prescribed that passengers have to produce original proof of identity during the journey in the following cases:

1. For e-tickets, any one of the passengers booked on the ticket has to produce any one of the prescribed proofs of identity in original.

2. For Tatkal tickets, the original proof of identity as indicated on the ticket.

3. For journey in Air-conditioned classes, any one of the passengers booked on the ticket has to produce any one of the prescribed proofs of identity in original.

For other than Tatkal and e-tickets, no instructions regarding production of proof of identity while travelling in non Air-conditioned classes have been issued, so far.

Reservation of Seats in Medical Colleges

Reservation in undergraduate seats in medical colleges for Scheduled Castes (SCs) and Scheduled Tribes (STs) varies from State to State as per the norms and rules prescribed by the respective State Governments. However, the following reservation quota is prescribed for admission to undergraduate and postgraduate medical courses under the All India Quota and central Government institutions:

i. Scheduled Castes – 15%

ii. Scheduled Tribes – 7.5%

iii. Other Backward Classes – 27% ( only in central Government Institutions/Universities)

Further, the regulations of Medical Council of India’s (MCI) provides that for both PG and UG, 3% seats of the annual sanctioned intake capacity shall be filled up by candidates with locomotors disability of lower limbs between 50% to 70% and in case the quota remains unfilled on account of unavailability of such candidates then such unfilled seats shall be filled by candidates with locomotors disability of lower limbs between 40% to 50%. These regulations are mandatory in nature and therefore applicable for every medical colleges under the ambit of MCI and also for admission to undergraduate and postgraduate medical courses under the All India Quota.

Reservation for Ex-Servicemen

There is no provision for earmarking of posts exclusively for ex- servicemen therefore the data on the actual number of reserved posts and unfilled vacancies earmarked for the Ex-servicemen are not maintained. However, percentagewise reservations ranging from 10 to 24.5% of the total available vacancies in Group C & D posts in Government jobs and Public Sector Undertakings have been provided for the willing and eligible Ex- servicemen.

It is the responsibility of concerned organization to fill the vacant posts. However the government endeavours to explore every possible avenue for increasing employment opportunities for the Ex-servicemen through various initiatives including trainings and awareness programmes. Moreover, the State Governments have also been advised to fill up the vacancies reserved for Ex-servicemen expeditiously. Since the Department of Ex-servicemen Welfare has no mandate to monitor the job reservations for Ex-servicemen, the matter has been taken up with Cabinet Secretariat in consultation with Department of Personnel & Training to empower Department of Ex-servicemen Welfare to monitor the same through appropriate changes in relevant rules.

As per information received from 37 Ministries/Departments of Government of India, the number of backlog reserved vacancies of the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes as on 01.11.2008 were 3537, 2969 and 6439 respectively.







The Government has launched a Special Recruitment Drive to fill up the backlog reserved vacancies of SCs, STs and OBCs.

Sub: Reservation for the Persons with Disabillties – Filling up of the backlog reserved vacancies through a Special Recruitment Drive.



The undersigned is directed to invite attention to this Department’s O.M. of even number dated 27.11.2009 whereby a Special Recruitment Drive has been launched to fill up the backlog reserved vacancies of persons with disability. Attention is also invited to this Department’s O.M. No. 36035/8/2003-Estt(Res) dated 26th April, 2006, which, inter alia, required preparation of reservation roster registers and earmarking of reservation for persons with disabilities in accordance with the instructions contained in this Department’s O.M. No. 36035/3/2004-Estt(Res) dated 29.12.2005 starting from the year 1996. The OM provided that if some or all the vacancies so earmarked had not been filled by reservation and were filled by able bodied persons either for the reason that points of reservation had not been earmarked properly at the appropriate time or persons with disabilities did not become available, such unutilized reservation might be treated as havlng been carried forward. There may be some vacancies which might have become available for persons with disabilities in terms of the OM dated 264.2006 It has been decided to fill up all such vacancies during the Special Recruitment Drive referred to above.



2. All the Ministries/Departments etc, are requested to scrupuiously implement the above decision.
