SUBJECT: SCHEME FOR ENGAGEMENT OF A DEPENDENT OF DECEASED GDS ON COMPASSIONATE GROUNDS – MERIT POINTS AND PROCEDURE FOR SELECTION – CLARIFICATION REGARDING

This has reference to your office letter No. Staff/175 -SEL / 2013 dated 29.08.2013 on the subject cited above.

2. In this context, it may be clarified that the Scheme was initially introduced in case of GDS subject to the same condition applicable to regular employees under No. 43-212/79/Pen dated 04.08.1980.  With the introduction of the merit points and procedure for selection under letter of even number dated 14.12.2010 as amended from time to time, all conditions applicable to compassionate appointment scheme relating to regular employees continue to apply in matters the Scheme does not envisage a specific provision in the context of compassionate engagement of a dependent of the GDC [in case of death only].

3. However, the doubts raised are clarified as under, which are in conformity with the provisions applicable to regular employees:-

1	Whether in case of death of GDS staffs, some points/score system for “outstanding liabilities for Education/Marriage of dependent children” “will be similarly applicable to unmarried sisters  (Whether minor or major) in case of unmarried deceased official?	Yes.  Brother or sister in case of unmarried GDS are considered as dependent family members for the purpose of consideration of engagement on compassionate grounds.
2	In a case where the son of the deceased official who is applying for the job have attained majority age, working as cultivator, married and is having children residing with the family of the deceased, will he, his wife and children be considered as dependent of the deceased official or only he will be considered (without considering his wife and children as dependent) for earning points/scores for compassionate appointment?	None.  A married son is not considered dependent on a GDS.
3	What is the definition of family for considering compassionate appointment cases, whether grandchild/grandchildren of the deceased official (blood relation) will also be considered part of the family of dependent/liability for education and marriage (in case granddaughter) for earning points/scores for compassionate appointment?	No. The Scheme was initially introduced in case of GDS subject to the same conditions applicable to regular employees under No.43-212/79/Pen dated 04.08.1980.  The term defined in case of regular employees holds good in case of GDS also.  Grandchild/children are not considered dependent on a GDS, Dependent family member for the purpose means: (a) Spouse; or (b) Son (including adopted son);or (c) Daughter (including adopted daughter); or (d) Brother or sister in case of unmarried GDS
4	Whether brother also is a dependent of the deceased official and if so up to what age he will be considered dependent and will he be entitled for points/scores for all liabilities?	Unmarried brother is considered dependent in case of unmarried GDS irrespective of age provided he was wholly dependent on the GDS at the time of his/her death & he must support other dependent members of the family & thus entitles to points/scores for all liabilities.
5	In case of an unmarried daughter/Son residing with the family and who have discontinued study at the time of death of the deceased official, whether education will be taken as liability and if so, up to what age?	No. Points will be allowed in those cases only where the dependent family member was undergoing education at the time of death of the GDS
6	Whether divorced daughter returning to the family with children will be entitled for Points/ Scores for unmarried liability for  her subsequent ,marriage?	Yes.
7	Whether in case of death of departmental staff, the status of an only married daughter with husband staying with the family (with no other family member) of the deceased departmental official will be entitled to compassionate appointment in case of death of her father (a case of  Meghalaya) ?	So far as the matter is confined to compassionate engagement of dependent of the GDS is concerned, married daughter can be considered for compassionate engagement provided she was wholly dependent on the GDS at the time of his /her death in harness and she must support other dependent members of the family

4. Contents of this letter may please be disseminated to all concerned. This issues with the approval of competent authority.

(1) Inclusion of Gramin Dak Sevaks under the purview of 7th CPC

(2) Regularisation of Casual, Part-time, Contingent Employees and Revision of their wages with effect from 01.01.2006 (as per 6th CPC wage revision) & Grant of DA

(3) Merger of 50% DA with pay for all employees including GDS

The above decision was taken in the Central JCA Meeting held on 19.10.2013 at New Delhi under the Chairmanship of Shri. T. N. Rahate, President, FNPO.

HIGHLIGHTS OF DRAFT POST OFFICE BILL 2011

1. Opening of market by reducing the exclusive privilege of Central  Government.

            Gradual opening of the market by phase wise removal of the monopoly proposed. Exclusive privilege reduced up to 150 gm. In case of letters and up to 50 gm. in case of express mail. Couriers can carry letters even within 150 gm and 50 gm ( the reserve area) subject to them charging twice the postal rates for letters and twice the rates for express service.

2. Sunset clause:

            A 15 years SUNSET clause for complete removal of exclusive privilege in express service and Parliamentary Review of exclusive privilege in case of letters is proposed.

3. Universal Service Obligation of the Central Government:

            As proposed, USO is defined as the obligation of the Central Government to provide, through the Department of Posts, basic postal services at reasonable access, affordable price and with specified service parameters throughout the country. Commitment to provide postal service, delivery and access to post office 6 days of the week except holidays.

4. Definitions:

            Definitions of certain 'terms' are proposed keeping in view the definition adopted by different countries, as also the requirement of customers i.e.

a) "postal services" means services provided by the Central Government
     or on its behalf and includes services related to
(i) handling of addressed letters,
(ii) handling of addressed parcels and packages,
(iii) handling of addressed press products,
(iv) handling of these articles as registered or insured mail,
(v) express services for these articles,
(vi) handling of unaddressed articles,
(vii) Value Payable Post,
(viii) money remittance
(ix) Post Office Counter Services
(x) services on behalf of any Ministry or Department of the Central or
    State Governments, or services on behalf of any other organization
(xi) other services not specified elsewhere;
b) "courier services" means services related to the handling of articles of mail i.e.   collection, sorting, dispatch, conveyance and delivery including
(i) handling of addressed letters subject to provisions in Section 4,
(ii) handling of addressed parcels and packages,
(iii) handling of addressed press products,
(iv) express services for these articles subject to provision in Section 4
(v) handling of unaddressed articles,
c) "express services" means postal / courier services related to handling of articles of mail and expedited delivery within a clearly specified and declared time limit with confirmation of receipt and with or without end‐to‐end integration to ensure track and trace and a record of delivery ;
d) "Registered Courier" means any person registered as such under Section ‐‐‐and includes his employee or agent or assignee;
e) "Licensee" means a Registered Courier who has been given license under Section ‐‐;
5. Registration and Licensing:

            The Central Government may grant registration to any person undertaking the provision of any courier service in India, who shall be called a Registered Courier. The Central Government may also grant license to any Registered Courier, who shall be called a licensee, for providing certain specific services. There is no registration fee or license fee. Licensing conditions involve adherence to quality, guarantee relief to customers in case of any deficiency in service and commitment to ensure confidentiality and security of letter. All operators will require registration for providing any type of courier service in India. But license will be required only for reserve area, USO and letter mail.

6. Registering Authority:

            It is proposed that Central Government shall appoint Registering Authority, in such manner and to perform such functions, as may be prescribed.

7. Appellate Authority:

            An Appellate Authority is proposed for redressal of grievances of any person aggrieved by an order of Registration Authority.

8. Setting up Extra Territorial Offices of Exchange (ETOE) and International mail Processing Centers (IMPC) abroad:

            Central Govt. may establish ETOEs/IMPCs in other countries for providing international Mail Services including express and parcel services subject to arrangements with such Postal Administrations regarding terms and conditions.

Modernisation of Department of Posts

Government has approved the ‘IT MODERNIZATION PROJECT’ of Department of Posts for computerization of Post Offices, Mail Offices, Administrative Offices and other field offices. This will involve establishment of required IT infrastructure, development of required software applications with an outlay of Rs.1877.2 crore.

The project has the following salient features:

• It will establish IT infrastructure of Data Centre and Disaster Recovery Centre and networking of all Departmental Post Offices including appropriate connectivity in the Branch Post Offices in the rural area.

• The project envisages development of integrated modular scalable applications for Mail, kBanking, Postal Life Insurance, solutions for Accounts and HR operations of the department.

• The rural post offices will be provided with rural ICT devices with required applications for performing Postal, Savings Bank, Insurance, MGNREGS and Money Order operations.

• Provision has been made for training, change management, capacity building of the employees of the department along with Project Management activity for smooth and timely implementation of the project.

It is planned to network all Departmental Post Offices and Branch Post Offices in the country subject to availability of connectivity and resources under the “India Post Technology Project-2012”.

The departmental Post Offices are proposed to be networked with appropriate connectivity. Branch Post Offices located in rural areas are proposed to be networked using available connectivity at these locations. The rural ICT Devices in the Branch Post Offices will have the capacity to work in both online/offline mode. The IT project is expected to be implemented by 2012-13 subject to the availability of funds.

This information was given by Shri Sachin Pilot, the Minister of State for Communications and Information Technology in written reply to a question in Lok Sabha today.
